By engaging Kirkendall Creative ("we," "us," or "our") for any web design or related services, you ("Client") agree to the following terms.
Kirkendall Creative provides web design, development, and related digital services. The scope of work for each project is agreed upon before work begins. We reserve the right to decline any project at our discretion.
We offer an initial website concept at no charge. No payment is required until you review the concept and choose to proceed. If you decide to move forward, payment terms will be outlined in your project agreement. All fees are in Canadian dollars unless otherwise stated.
Each project includes a set number of revision rounds as specified in your project agreement. Revisions beyond the included rounds may be subject to additional fees.
You agree to:
Upon receipt of full payment, all deliverables become your property. We retain the right to display completed work in our portfolio unless otherwise agreed in writing. Any third-party assets (fonts, stock images, plugins) remain subject to their respective licenses.
We treat all client information as confidential. An NDA is included with every project upon request. We will not share your business information with third parties without your consent.
Kirkendall Creative is not liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability is limited to the amount paid for the specific project in question.
Either party may terminate the project agreement with written notice. If you terminate after work has begun, you are responsible for payment for work completed up to that point. If we terminate, we will refund any fees paid for work not yet delivered.
These terms are governed by the laws of the Province of Ontario, Canada. Any disputes shall be resolved in the courts of Ontario.
We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the revised terms.
